iPhone Jailbreaking and Unlocking Declared Legal in US

The Library of Congress has declared iPhone jailbreaking and unlocking as legal. New anti-circumvention exceptions has been introduced to the DMCA policies that now legally allow iPhone owners to jailbreak their devices and let them install 3rd party apps (not provided by iTunes Store).

According to the Associated Press, the decision to allow the practice commonly known as “jailbreaking” is one of a handful of new exemptions from a federal law that prohibits the circumvention of technical measures that control access to copyrighted works. Every three years, the Library of Congress authorizes such exemptions to ensure that existing law does not prevent non-infringing use of copyrighted material. Another exemption will allow owners of used cell phones to break access controls on their phones in order to switch wireless carriers.

This is, indeed,a great news for the jailbreak community! Spirit jailbreak for iPhone 4 and UltraSn0w unlock for iPhone 4 both will be out in a few days.

You guys out there. I really need a big favor from you.

I bought the second hand iPhone 4 from A guy in USA.

And now I’m in Cambodia.

When I try to synchronized iPhone, the iTunes is requesting my billing zip code

and a social security number.

But I don’t have AT&T account and I don’t have SSN. I try to reached the guy

who sold the phone but he never answer. So I’m very worry that once the new

spirit comes out, it won’t be able to jailbreak my device since I’m stuck in the

slide to emergency screen. So please guyz help me to get into the home screen!!! Please…

have you tried activating it with the phonebook simcard? i think that should help. find the link somewhere here in this website. order that sim card, then voila! it is now activated!

guess what dude, you already posted in that post, you said you already have the phonebook sim card and you already activated it. now i am confuse why you need to activate it again??

Well I refer to the iPhone 3GS. Not iPhone 4.. That simcard works with iPhone 3G and 3GS. I try with iPhone 4 and it didn’t get me to homescreen.

At that time My iPhone 4 didn’t arrive yet.. And when it arrived, I try with that simcard and it get me to where they need to fill in the billing zip code and ssn on iTunes..

So you mean the phonebook simcard cannot be used with iphone4? #iphoneheat should know this and update his recent topic in how to activate iphones without the original sim.

Nope it doesn’t work. I hope next time spirit can jailbreak on non activate iphone 4. Because most of iPhone 4 user are upgrade from their 3GS. So the itune will request for billing zip code and ssn before activating the iphone 4.

So if u guys out there planning to buy a second hand iPhone 4, make sure to ask the seller to activate the iPhone 4 for u. Otherwise u will end up like me…

When I activated my iphone 4 with my legit sim, it didnt ask me about those things.. When you bought your iphone4 in the US, he did not activate it first before selling it to you? I am from the UK btw, dont know if there is a difference activating the iphone4 from the US.

Well no.. He didn’t activate for me. So now my iPhone 4 is stuck in the emergency screen. But today one of my friend brought the iPhone 4 from France. I try to activate the phone for him using my local carrier sim, the iTunes said sorry the sim u insert is not support bla bla bla.. Then I sulked.. I thought iPhone 4 from uk and France are factory unlock so it didn’t activate the iPhone. Well then I cut the activation sim card to fit it the slot and syncing again. This time it gets me to homescreen. The phone display ” waiting for activation” then I insert the local carrier sim again but it popes up “invalid sim”.
I really don’t understand why this is happening? Did I miss some steps? Or the iPhone from france is also locked? If any of u guys from France, please give us some ideas. Thanks..

ITS NOT BIG DEAL IF JB & UNLOCK ARE LEGAL NOW, BUT IT WOULD BE IF APPLE GIVE US THE OFFICIAL TOOLS TO JAILBREAK & UNLOCK THE DEVICES ( BTW, THEY SHOULD DO IT )

they will release the files which work for everyone, every carrier not just in Cambodia. As they had mentioned, they will release when it done. Dev team has found some error after they expected to release earlier this week. hope they can release by this week or by July 31 2010. Not only two of us, but million of million ppl around the world were stuck with this.

What we have to do is to wish the dev team can fix the this up and release it today or tomorrow.

From my personal view, the Jailbroken process was not mainly to get other apps, but to unlock the default carrier. I like this news because after all we all wanted is to choose who do we stay in as phone provider. But now I began to wonder this: If you can choose any carrier you want, therefore iPhones will be “open carrier” devices? If so, there will be no need to JB in the first place, unless you desperately need an specific app not for sale at the app store. Will Apple sell iPhones with no carrier? Will the telephone companies get the specific tools from Apple to enable the company’s carrier?
If this “open carrier” devices are allowed, then will be there the chance to buy it from Apple Website or any other place? Will this mean that prices of the device will drop to its truly $299 usd, that once Steve Jobs claimed for the 3Gs on his keynote?

For the developer side, I think the Appstore will continue strong simply because it the perfect sells platform for any developer without the budget of major companies like EA, for example. Selling an app on your own with your website with out this platform will be extremely difficult, so my bet is that many developers will continue to offer their apps on the Appstore. My two cents.

yea man i got a very expensive brick on my hands…got a US unit that wasnt activated, no matter what other at&t card i slip into it, the phone insists on being activated with the original owner details.
this blows…

Hey buddy… Ur iPhone also ask for the billing zip code and ssn number right? U bought from someone in the US right? So what are u going to do about it? I’m now try g to upgrade to 4.0.1 to see if the itune still need those info to fill in.. I’ll let u know.. By the way u can email me [email protected]. We are pretty much on the same boat here..
